Terms of Service

These Terms govern your use of trulybyowner.com (the "Site"), operated by Truly By Owner ("we," "us"). By using the Site, listing a property, or contacting an owner through it, you agree to these Terms.

1. What we do

Truly By Owner is a listing service. Property owners pay us an annual membership to display their vacation rentals. Guests find homes on the Site and contact and book with owners directly.

We are not a party to any rental agreement between an owner and a guest. We do not own, manage, inspect, or operate any listed property, and we do not process guest payments.

2. For guests

• Your booking, payment, cancellation, refund, and any dispute are between you and the owner.
• Read each owner's house rules and cancellation policy before you book.
• We do not verify every listing detail. Confirm anything important with the owner before paying.
• Never send payment to anyone who asks you to pay outside the method the owner lists, or who pressures you to pay urgently. Report suspicious listings to us.

3. For owners

• You must own the property or be authorized by the owner to rent it.
• You are responsible for the accuracy of your listing, including photos, descriptions, rates, availability, and policies.
• You are responsible for complying with all laws that apply to your rental, including local short-term rental rules, permits, licenses, occupancy limits, safety requirements, and lodging or sales taxes.
• You are responsible for your own rental agreements, guest screening, payment collection, insurance, and the condition and safety of your property.
• You may not list discriminatory terms, or post false, misleading, or infringing content.

4. Membership fees

Owner memberships are billed annually per listed property at the price shown at the time you join. Membership covers one listing for twelve months. Memberships renew once a year on the anniversary of your purchase date.

Refunds. Membership fees are non-refundable, with one exception: if you cancel on the same calendar day you purchased, you may request a full refund. If a refund is issued, your listing will be removed from the Site immediately.

We may change membership prices for future terms. Any change applies at your next renewal, and we will tell you in advance.

5. Content you provide

You keep ownership of the photos and text you submit. You give us permission to display, format, and promote that content on the Site and in our marketing while your listing is active. You confirm you have the right to share it.

6. Removing listings

We may edit, suspend, or remove any listing or account that violates these Terms, receives credible complaints, or puts guests at risk.

7. Disclaimers

The Site and all listings are provided "as is." We make no promise that any listing is accurate, available, safe, or suitable. To the fullest extent the law allows, we disclaim all warranties, express or implied.

8. Limitation of liability

To the fullest extent the law allows, we are not liable for any injury, loss, damage, or dispute arising from a stay, a property, or any dealings between owners and guests. Our total liability to you for any claim related to the Site is limited to the membership fees you paid us in the twelve months before the claim, or $100 if you paid nothing.

9. Indemnification

Owners agree to defend and hold us harmless from claims arising from their listing, property, rental, or violation of these Terms or the law.

10. Governing law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules.

11. Changes

We may update these Terms. The effective date above shows the latest version. Continuing to use the Site after a change means you accept the updated Terms.
